Dated 27th April 1822 - PCC Will of Thomas Shearley of Bexley, Butcher. First, all his debts, funeral and probate costs to be paid. His freehold house and shop, with garden and outhouses; his freehold land in Bexley and all other real estate in Bexley, to his son, Thomas, for ever, but subject to certain charges. If son, Thomas dies in his father's lifetime, leaving issue, then his bequest to his children, equally shared; but if he leaves no children, then the bequest goes to son, John, for ever. His trade as a butcher and profits, with horses, cattle, live and dead stock and implements of trade, all ready money, household goods, furniture, china, glass, beer, wine and liquors, property and effects, (except plate and linen), all debts due to business, to son Thomas, subject to Thomas paying his debts and paying his mother, Elizabeth and brother William, £50 each. Also to wife, Elizabeth, all plate and linen and an annuity of £60 for life, chargeable on his freehold property. His freehold called Jeskins and all other freehold estate in Cobham, to his wife, for life. After her death, then to son John, for ever. If John dies in his lifetime, then to his children, equally shared. If John leaves no children or his children die under 21 years, then the estate to son Thomas, for ever. His farm called Grays in St. Paul's Cray and Chislehurst, which he holds from the Right Honourable Lord Sydney, with all crops, hay, corn, straw, fodder, manure and other produce, to son Thomas, subject to certain condition and payment of rent and taxes. His farm at Hockenden in St. Mary Cray, which he holds from James Chapman, Esquire, with all the crops, to son John, subject to certain conditions and payment of rent and taxes. All his horses, cows, bullocks, pigs, sheep and other live stock, wagons, carts, ploughs, harrows, harness, rolls and other implements, on his farms of Grays and Hockenden, to sons, Thomas and John, equally shared, to avoid dispute, the division to be made by his friend, Thomas Stranger of Orpington, but if he is dead, then by such person chosen by his wife and son in law, John Cook. He has paid the rent of Hockenden for four years in advance; son John is to pay his brother, Thomas, half of such rent paid after testator's death. To daughter, Elizabeth Shearley, £1,000; to daughter, Ann wife of John Cook of Bexley, Miller, £500, these sums to be paid within 5 years of his death, by sons, Thomas and John, half from his property at Bexley by Thomas and half from property at Cobham, by John, after the death of his wife. Within a month of his death, son Thomas will enter a bond, in double penalty, to his daughters, for payment of half of each daughters legacy. If any daughter dies in his lifetime, their legacy to her children, equally shared, If she dies leaving no children, then Ann Cook's legacy to her husband, if living, but if dead, then to daughters, Elizabeth and Susan, equally shared. He is executor and residuary legatee of his brother in law, William Comport and is to pay a £200 annuity to brother in law, George Comport and an annuity to Hannah Couch. He gives all his money in the Public Funds and leasehold estate in Cobham, now let to [ ] Parks, to his executors, upon trust. They shall pay the annuities. The surplus income of the latter, to sons Thomas and John, equally shared. If his funds are not enough to pay the annuities, the the shortfall to be made up by his sons, in equal shares. To his daughters, Elizabeth, Ann and Susan, additionally, £4,000, equally shared, after the death of George Comport, this is the sum that the latter's annuity is funded from. If any daughter dies in his lifetime, then their share to their children, equally shared. To his wife, a further annuity of £40 to be paid by his sons, equally shared. Residue of personal estate, to his two sons, equally shared. If son John is a minor at testator's death, then his wife and John Cook will be his guardians during his minority, son Thomas will farm the Hockenden business. If either of his sons died in his lifetime, leaving children, then their legacy to his children at 21 or day of marriage, if girls, if sooner. If either die leaving no children, who live to 21, then, or John survives his brother but dies a minor, then their legacies to his daughters, equally shared, or to the children of any who have died, equally shared at 21 years. Trustees to invest funds in Government or Real securities and use the interest earned, to fund the maintenance and education of any of his children who are minors. Witnesses: Charles Kite, the mark of Bridget Gouch and William Rolfe. Codicil made same day He has conveyed his property to Thomas Shearley, except the the £200 per annum to his brother, George. Identified in 1839 as William Shearly "jnr" as the owner of Four Acre Field in Bexley, then occupied by his brother Thomas Shearley, thus he may be absentee. He may be the William Shirley age 67 (b 1784) Bexley Kent, surgeon not practicing, widowed living in HH of Robert Greenhalgh at Tottenham Court St Pancras London in 1851 census. This William Shearly was a distinguished member of the Royal College of Surgeons, London with numerous medical publications to his credit. He practiced at Deal Kent, the location of a Royal Naval Hospital; Lived at St Mary Lambeth Surrey in 1841 census, age 55, surgeon, wife Charlotte, dau Catherine age 10 (Note: the connection between William the royal surgeon and Bexley is made in the 1851 census, but need say an apprentice record, or military record)

Named by his sister Elizabeth in her 1832 will as the heir of all her property; Living at Bexley Kent in 1851 census, age 63, occupation: butcher; Also living in the household in this census is Susannah Shearly a "cousin" age 56 born Wilbracht Street Cavendish Square [St Marylebone Parish, Middlesex] Enumerated at Bexley in 1861 census, age 75 (again 'cousin' Susanna Shearly age 73 in HH), He died 8 April 1862 at Bexley and was buried at Bexley Kent on 15 April 1862, age 75.

(need proof of this) Some have pinpointed this Nicholas Shearly as living at Belringham House Sutton valence Kent in the 1850s, but there is a different Shirley family in SV at that time, and Belringham House was a magnificent Georgian home - occupied by a 25 year old, father still living? (was destroyed by fire in 2021) And that Nicholas Shearly esq of Belringham House Sutton Val. died 13 Mar 1860, age 69 (Morning Post newspaper). Find him in the lineage below.

2(x). John Shearley, gent. chr 31 Jan 1804 at Bexley; Named in his father Thomas Shearley's 1827 will; PCC will probated 1833, of Orpington Court Lodge. He does not name any wife or children in his 1833 will.

He named his mother Elizabeth Shirley and his sister Ann who married John Cook of Dartford Kent and sister Susanna who married George Wilding. He also named as his executors Nicholas Shearley of Cavendish Square, Welbeck Street Middlesex, butcher and David Griffiths. This Nicholas is likely his 1st cousin, see below

1793 Prerogative Court of Canterbury Will Dated 2nd May 1793 John Huggins, Butcher [of Cobham Kent]. He appoints his wife, Elizabeth, cousin James Hulkes and brother in law, Thomas Shearly, executors. James Hulkes of Strood, Baker, his late uncle, bequeathed , by his will, dated 4th July 1776, the dividends and profits of the rest and residue of his ready money, debts, plate, linen, woollen, pewter, brass, beds, bedding, household stuff and implements, goods, chattels and personal estate, to his wife, Ann, for her lifetime. After her death, then to his nephews and nieces, children of his brother, Thomas Hulkes and his sisters, Ann Hurt and Elizabeth Huggins, in equal shares. The testator, John Huggins, will be entitled, on the death of his aunt Ann Hulkes, to a share of his uncle's personal estate. If he dies before his aunt, his executors to pay his widow, his share of the bequest. All his stock in trade, ready money, plate, linen, woollen, pewter, brass, beds, bedding, household stuff and implements, goods, chattels and personal estate, after his debts, funeral and probate costs are paid, to his wife, Elizabeth. Nicholas Shearley, butcher of Welbeck Street St Marylebone MDX chr 22 Feb 1756 at Bexley apparently born after the death of his father Nicholas Shearley; His children were christened at St Marylebone Parish, Middlesex. He is taxed on land in St Marylebone Parish Middlesex beginning in 1791 through at least 1799 (end of data). He died 30 December 1824, age 69. His burial memorial is found in the churchyard of St Mary and St Nicholas, Leatherhead, Surrey If son Thomas Shearly did not leave male issue then this Shirley family died out in the male line

Nicholas Shearley, gent chr 31 August 1791 at Saint Marylebone Parish to Nicholas and Rebecca Shearly; He was very likely the Nicholas Shearly of Welbeck Street of Cavendish Sq [St Marylebone] Middlesex, butcher, who was co-executor of his 1st cousin John Shearley's 1833 will (see above); He lived both at 73 Welbeck Street and at Belringham House, Sutton Valence Kent; He was enumerated at Marylebone Middlesex in the 1851 census, age 59, unmarried, occupation: retired butcher; In his household was Charles Sanders (cousin) and Elizabeth Huggins (cousin) and Ann Sanders (cousin). He died 13 March 1860. His will was probated in the general registry in 1860. His burial memorial is found in the churchyard of St Mary and St Nicholas, Leatherhead, Surrey

George Hodgson gent coroner. View the body of Henry Shearly then and there lying dead. Henry Shearly came to his death upon their oath in the 17th day of October the the year aforesaid being in a room there wherein there was a fire it so happened that the said fire caught the cloaths which the said Henry Shearly then and there had on his body by means whereof he was very much scorched and burnt of which scorching and burning he languished until the 22nd day of October and then died. Said Henry Shearly in manner and by means aforesaid accidentally came to his death and not otherwise.
