March 2020 Breakthrough: Editor: I researched this family at the Virginia archives many years ago. Following the lead of family tradition, I also researched York Co PA records for this family while at the Mormon archive/library in Salt Lake. It was through this search and through a descendant's recollection of names and dates (see Misc link above) that I began to suspect the family had orignally been surnamed SHIREY, not Shirely/Shirley. The Shirey names in York Co PA Orphans Court records were all the same and the dates were correct to be the Shirelys of Berkeley and Morgan Co VA. I reviewed old notes for York PA Orphans Court records for the Shirey family this morning and discovered additional tangible links connecting the Shirey family of York PA to the Shirely family of Berkeley and Morgan Co VA (WV). For example, Jacob Stanbaugh was identified as the brother in law of John Shirey of York Co PA in 1813 Orphans Court records there. In 1829, the children of the same Jacob Stanbaugh were assigned to John Shirely of Morgan Co VA as their guardian. A descendant also recollected that John Shirely's sister Mary had married an Adam Stanbaugh (No doubt a relative to Jacob Stanbaugh in retrospect); The final link was made today when I found a deed of John Shirey of Berkeley County VA and his wife Christina selling his inherited land in York PA in 1818. The wife of John Shirely who lived in Berkeley Co VA during this time and who later lived and raised his family in Morgan Co VA (later WV) was also named Christina.

John Shirey
of Manheim Township, York Co PA; He died intestate in York Co PA sometime before 1813 when gardians were appointed for several of his minor children by the York Co Orphans Court. His heirs petitioned for John's land located in Manheim Twp York Co PA to be partitioned in December 1813.

1813 Dec 14 - York Orphans Court Book L page 70 -Petition of George Lawmaster in right of Magdalena his wife and George Nunnemacher in right of his wife Catherine, that John Shirey late of Manheim Township in co of York deceased died intestate leaving a widow named Magdalena and seven children lawful issue namely John his oldest son, Magdalena and Catherine above named, Susanna the wife of Jacob Stenbach, Mary, Daniel and Peter. The intestate died seized of a fee of a certain planatation situate in Manheim Twp adj John Boersox. Felty Dewalt, Henry Blocker and ___ Libe containining 114 acres which the above named widow and children hold together . Request for partition

married Magdalena [Mary] ________ She was named widow in the petition for the partition of her husband's land in 1813; Her son Peter Shirey/Shirley identified his parents as John and Mary in his 1868 marriage

Children:

1(i). John Shirey/Shirely born about 1778 PA; Identified as eldest son in the petition for partition of his father's land in York Co PA in 1813; He and his wife lived in Morgan Co. VA.  now West VA. He and his brother Daniel Shirey/Shirely moved to Berkeley Co VA (later WV) before 1818 when John Shirey (sic) and wife Christina sold his father's land (as heir) in York Co PA to Jacob Lowmaster, no doubt a relative of his brother-in-law George Lawmaster (York DB 3C pg 376). This family changed the spelling of their surname to 'Shirely and members used that spelling well into the late 1800s. In 1829 John Shirely was ordered by the Morgan Co VA court to act as guardian to the children of Jacob Stenbaugh deceased. Jacob was the husband of John Shirey/Shirely's sister Susanna Shirey (See 1813 York PA Orphans court land partition); Tradition said his parents came from PA to Frederick Co. VA in 1822 and lived near Siler VA. John Shirely's estate was recorded in Morgan Co WV in 1857, naming his heirs.

1816 May 22 York Co Pennsylvania DB 3A pg 442 Power of Attorney John Shirey, Christina Shiery to Jacob Lowmaster - We John Shiery and Christina Shiery heir at law of John Shiery late of Manheim Twp York Co PA deceased at present residing in the County of Berkley state of Virginia do nominate our beloved friend Jacob Lowmaster of York Twp York Co PA as our true and lawful attorney to sell and dispose all the right-title claim and interest we have to a certain tract of land in Manheim Twp late the property of the said John Shiery dec'd who dying intestate the sd lands would not admit of a division, and by Orphans Court 4 April 1814 the sd tract was assigned to me the sd John Shiery under several restrictions; Land adjoins John Bowersox, Felty Dewalt, Henry Blocker, and others containing 114 acres subject to the widow's dower; Dated 22 April 1816 <s> Johanne [illeg], Christina X Shiery; Delivered in the presence of John Shober, John Lowmaster of Berkley County VA

married Christianna Youst. She was identified as John Shirey/Shirely's spouse in the sale of her husband's land in York Co PA in 1818

1(ii). Magdalena Shirey named as daughter of John Shirey deceased in 1813 York PA Orphans Court record; She married George Lawmaster sometime before 1813 in York Co PA

1(iii). Catherine Shirey named as daughter of John Shirey deceased in 1813 York PA Orphans Court record; She married George Nunnemacher sometime before 1813 in York Co PA

1(iv). Susanna Shirey named as daughter of John Shirey deceased in 1813 York PA Orphans Court record; She married Jacob Stenbach sometime before 1813 in York Co PA; He died in the 1820s at which point his brother in law John Shirley (sic) was appointed guardian to all his children in Morgan Co VA (later WV)

1(v). Mary Shirey named as a young child of John Shirey deceased in 1813 York PA Orphans Court record; She was also identified as sister of John Shirely and Daniel Shirely by descendants of this family (See link "Miscellaneous" at top of page for more information)
