James Shirley
born in the 1750's (Updated estimated birthdate), probably in Prince William County Virginia. He is first noticed as a witness to the 1774 will of George Nevill of neighboring Fauquier Co VA, then again enumerated in the 1777 Fauquier County rent rolls. In 1780, he furnished seven bushels of Rye to the Commonwealth of Virginia for army provisions in the Revolutionary War effort. The next year, he married Mary McMekin in Fauquier County on 9 October 1781. He does not appear in the 1782 titheable list for Fauquier County, but is likely the same James Shirley who next appeared on 1782 and 1783 personal property tax rolls for Prince William county, being tithed and owning 1 horse, 1 cow in 1782 and 2 horses and 3 cows in 1783. Soon thereafter, James Shirley moved south to South Carolina. James and his wife Polly were received into membership of the Turkey Creek Baptist Church in Abbeville District South Carolina by baptism on 6 July and 7 May 1787 respectively. He and his wife Mary Ann "living in Abbeville Co SC" sold 300 acres of land in neighboring Pendleton District on 18 August 1789 (recorded 27 Apr 1791). In 1790 Abbeville District SC census, he is enumerated as over age 16, with three sons under age 16. The census also lists 3 females in the household, one presumably his wife Mary. He was still living in South Carolina when he was censored by Turkey Creek Church for drinking on 11 January 1791, then restored to fellowship on May 7. He does not appear in South Carolina records after that date and may have left about the time that Thomas Shirley applied for letters of dismissal from Turkey Creek church, 10 February 1798. James first appeared in Kentucky when he secured a land grant for 200 acres in Barren County on 25 July 1799. The 1800 census for Kentucky is lost, but James was enumerated in Barren Co KY in the 1800 tax rolls. He died July 23, 1801 Barren Co. KY.

married 2) Mary McMekin on 9 October 1781 by marriage bond in Fauquier County VA (note son Ezekiel's birth suggests that James married prior to Mary McMekin) She was widowed and taxed on 200 acres of land in Barren County KY in both 1803 with no males in household over the age of 21, and taxed again in 1805 with 1 white male between age 16 and 21; She was listed as widow and purchaser of items at the sale of her husband's estate as recorded in Barren Co KY in 1812. Her son Caleb Shirley was taxed for the same 200 acres in 1816; Her will was proven in Barren Co KY court in November 1835

1833 Barren Co KY Mixed Book 3 and 4 page 92 - Will of Mary Shirley - I Mary Shirley being of sound mind but weak and feeble in body do ordain this as my last will and testament. In the presence of God Amen. Item 1st I will and bequeath to my beloved son in law Presley N Thomas all of my estate consisting of house hold and kitchen furniture to have and to hold him and his heirs forever. Item 2nd I also will him to have my cow beast of which I have only one. Done this 22nd January and year of our Lord 1833. Given under my hand Seal state of Kentucky and County of Barren Mary X Shirley. Witness Joel Yancy [?], William ?Tryman, Lucy Tryman. Proven Nov court 1835.

Ezekiel Shirley born about 1776 VA; He appears in Scott Co KY as early as the 1796 tax list for that county; He appears in the minutes as a member of the Great Crossing Church; Mentioned in the 1797 estate record for Richard Shirley, dec'd; He was taxed in Scott Co KY in 1805 in the Eagle Creek area and in 1826 was taxed for 400 acres in that area; In 1828, Ezekiel and wife Dully sold 450 acres in Scott Co KY to Lewis Suggett, apparently in preparation to move to Indiana; In 1835, he was named as part of the Presbytery of the founding of Mt Tabor church near Brownsburg, Boone Co Indiana; He appears in the 1840 Boone Co IN census and thereafter; Ezekiel died 1864 Perry, Boone Co. IN and buried at Mt Tabor cemetery. Son of James Shirley according to the "History of Boone, Clinton and Hendricks Counties". Shirleys of Boone Co IN

1(ii). Robert Shirley born about 1780, age 26-45 in 1810 census. His date of birth is estimated at 1780 since he had 4 children under the age of 10 in the census household, thus say about age 30 at the time. He died in 1813 Barren Co.  .

married Elizabeth Shirley, daughter of Thomas and Mollie (Grubbs) Shirley. Robert and Elizabeth were 1st cousins.

1(iii). Jane "Jennie" Shirley married William Dale (brother of Elizabeth Dale who married Richard Shirley, branch #49); Her daughter America E Dale married Daniel R Shirley, son of Richard and Elizabeth (Dale) Shirley (Branch 49)

Caleb Witt Shirley born about 1839 IL, age 11 in mother's 1860 census household, age 19; served in the Union Army cavalry; 3rd and then 6th Regiment, Missouri State Militia Cavalry; Apparently discharged due to disability Mar 29 1863 at Warrensburg MO. The estate of Caleb W Shirley was administrated by T. J. Shirley in December 1867 in Carroll Co MO. Note: Caleb's middle name Witt is confirmed in a receipt he signed for money received from the estate of his father Jessee Shirley.
