2(iii). James Shirley born February 24, 1768, Frederick County, Virginia; He died January 16, 1840, Charles Town, Jefferson County, West Virginia. When a young man, and about the time of his father's death, James Shirley moved to the vicinity of Smithfield, Virginia (now Middleway, West Virginia).  He owned large properties, and continued to add to his possessions during his life, and died owning a large estate. James Shirley's Will is recorded in Jefferson County, West Virginia, Will Book 9, Page 409.  In it he gives his wife Matilda one third of his estate "both real and personal,"  stipulating that after her death her Dower was then to be equally divided between his sons Robert, George William, and Thomas Lee.  The remaining two thirds of his holdings were distributed to sons Robert, George and Thomas.  At his death James Shirley owned numerous tracts of land amounting to considerable acreage. A Plat of some of James' extensive holdings may be found in Will Book Book 24, Page 309, of  Jefferson County. James gave his sons several slaves by name.  All other slaves not named in the Will were to be equally divided among them (in an estate accounting all are named).  James did will that "my yellow boy named James Rust shall be free at the age of twenty one years at which time my executor hereafter named shall out of my estate furnish him with two good suits of clothes of good quality, and twenty five dollars in cash."  In the accounting of the estate the cost of Mr. Rust's two suits of clothing came to $57.54 (W.B. 10, p. 11). To his daughter Mary Hurst he gave "two Negroes by name Jerry and Lucy," and $1,000.00 cash. Burial: Episcopal & Masonic Cemetery, Middleway, West Virginia. Shirleys of Middleway Jefferson Co WV

married 1) Ruth Hiatt on March 05, 1793 in Berkeley County, (West) Virginia, daughter of John Hiatt.  She was born April 30, 1756, and died April 1817 in Charles Town, (West) Virginia. Ruth (Hiatt) Frier was the widow of Alexander Frier, Jr. at her marriage to James Shirley. Ruth's Father John Hiatt was an early settler in the region. married 2) Matilda Vinson on December 26, 1821 in Frederick County, Virginia.  She was born 1795 in Montgomery County, Maryland, and died September 17, 1855 in Jefferson County (West) Virginia . According to Carmen W. Creamer of Locust Grove in Jefferson County, West Virginia,  Matilda Vinson was a friend made at school by Mary Shirley, daughter of James Shirley and his first wife Ruth Hiatt.  Mary invited Matilda to her home in Jefferson County where she met and later married Mary's father James.  It is said Mary and her brother James disapproved to their father's marriage because of Matilda's age (they were about the same age as their new step-mother). married Mary Grantham on January 13, 1824 in Charles Town, Jefferson County, West Virginia, daughter of John Grantham and Mary Godwin.  She was born August 09, 1796 in Virginia.

4(i). Walter Shirley, born about 1825; He died. January 30, 1873, Middleway, Jefferson County, West Virgiinia. Walter Shirley foreman of the jury that convicted John Brown of Harpers Ferry fame. (see "John Brown" by O.G. Villard).

Spirit of Jefferson., February 04, 1873 - SAD ACCIDENT - This community was shocked on Friday last by learning of the sudden and untimely death of Mr. Walter Shirley, a highly respected and well-known citizen of this county, and brother of our Delegate in the Legislature, Jas. W. Shirley esq. It seems, from what we can learn, that Mr. S. started for home from the residence of Mr. Philip Gordon, at about dusk on Thursday evening, and a short time afterwards was found in the woods of Mr Ephraim Watson, by a little son of Mr. Gordon's with his head out of his body otherwise injured, having been thrown from his horse against a tree. Mr. Gordon immediately reparied to the spot and removed him to his house, where every effort was made to bring him to consciousness. All was unavailing, however and he expired in a few moments, having never spoken after the accident. The friends of the deceased have the sympathy of the entire community in their sad bereavement. His remains were attended to the grave on Sabbath last by a large concourse of relatives and friends.

married Elizabeth Sophia Bosley on April 06, 1854 in Baltimore, Maryland, daughter of Amon Bosley and Rebecca Marsh.  She was born November 14, 1828, and died March 09, 1897 in Middleway, Jefferson County, West Virgiinia.

4(ii). John Grantham Shirley, born April 12, 1826; He was a general merchant at Middleway, Jefferson county, Virginia. He held the offices of deputy assessor, sheriff of the county, and judge of the county court. He was a prominent Democrat. He died December 13, 1913, Middleway, Jefferson County, West Virgiinia.

married Mary Ellen Garrett, daughter of Silas Garrett and Rose Bates.  She was born October 30, 1839, and died February 22, 1907.

married Mary Lilie Farrish. She was born September 14, 1887; d. March 04, 1967, Jefferson County, West Virginia

5(iv). George Peabody Shirley, born December 31, 1868; He attended the schools of the county, and the Bowling Green Institute, Bowling Green, Caroline county, Virginia. He began the study of law at the University of Virginia and graduated in 1897 from the University of West Virginia with the degree of LL.B. Opening an office at Parsons, Tucker county, West Virginia, he entered on a successful general practice in the state and federal courts. In 1899 he was appointed by Federal Judge Jackson referee in bankruptcy and this position he still holds. He is a member of the State Bar Association, and has been secretary, treasurer and president of the Tucker County Bar Association. He has held chairs both in the Independent Order of Odd Fellows and in the Modern Woodmen of America. Mr. Shirley takes an active interest in civic affairs, but is not active politically. He is an Episcopalian, and his wife is a Baptist, active in the Baptist societies. He married a daughter of J. M. Tolbert, who is a farmer at Beverly, Randolph county, West Virginia. Children: Mary Margaret, born in 1901; George W., born in 1903; Virginia. He died in 1943.

5(viii). Evelyn Shirley, born October 18, 1878; d. 1942, Middleway, Jefferson County, West Virgiinia. She married Everett Farrish; b. April 19, 1853; d. August 27, 1903, Caroline County, Virginia.

4(iii). Margaret Amelia Shirley, born February 18, 1828; She died March 04, 1911, Middleway, Jefferson County, West Virginia. She married Solomon Adams Bates on December 19, 1849 in Jefferson County, West Virginia.  He was born April 10, 1815, and died May 03, 1887 in Middleway, Jefferson County, West Virgiinia.

4(iv). James William Shirley, born December 31, 1829; He died 1906, Jefferson County (West) Virginia.

married Julia Bowen.  She was born 1841 in Greenwood, Albemarle County, Virginia, and died 1906.

3(iv). Robert Vinson Shirley born March 1824, Virginia; He died August 17, 1914, Charles Town, (West) Virginia. Robert Vinson Shirley was a Major in the 55th Regiment of Virginia Militia.  He also served the CSA as a local quartermaster during the Civil War.

married Julia Moore Baylor on October 23, 1857 in Jefferson County, West Virginia, daughter of Robert Baylor and Mary Moore.  She was born April 07, 1837, and died January 18, 1904 in Jefferson County,  West
Virginia.

4(viii). Henry Garnett Shirley, born November 10, 1874, Summit Point, Jefferson County (West) Virginia; He died July 16, 1941. Henry Garnett Shirley graduated from the Virginia Military Institute in 1896.  He was an officer with the U.S. Volunteers in the Spanish American War.  In 1922 he became Chairman of the Virginia State Highway Commission.

married 1) Alice Washington Graham. She was born in Oxford, North Carolina. 

married 2) Sarah Ann Berkeley.  She was born in Richmond, Virginia.
